The Fair Transactions in Subcontracting Act (the “Subcontracting Act”) regulates special unfair trade practices to protect the interests of subcontractors who are economically disadvantaged, by preventing the prime contractor’s abuse of its superior position in subcontracting. The statute is subject to differing interpretations and regular amendments. In addition, the Subcontracting Act is becoming more stringent, and new issues have emerged, including, for example, the supply price adjustment system and technology takeovers.
